84-081 Cupertino Union School District- Wilson and Sedgwick Schools- Agreement for maintenance of certain school sites; Resolution #6467 AGREEMENT
This agreement entered into this 17th day of December , 19
by and between the CUPERTINO UNION SCHOOL DISTRICT (District) and the CITY
OF CUPERTINO (City) .
RECITALS:
1. District is the owner of certain school sites, which sites
contain grounds which are suitable for community use.
2. City is desirous of assisting District in the maintenance and
scheduling of use of said grounds so that the property can be
utilized to the maximum public benefit.
NOW, THEREFORE BE IT HEREBY AGREED as follows:
1. City shall maintain, at its own expense, the turfed areas at
the Wilson and Sedgwick school sites using its own equipment and
personnel for such maintenance services. The cost of the water at
said sites shall be borne by the' City.
2. District shall maintain Eaton School site.
3. It shall be the responsibility of City to receive applications for
use, issue permits and schedule use by the public of the grounds at
the two sites.
4. The term of the agreement shall be one (1) year, six (6) months
commencing January 1, 1985 and ending June 30, 1986. With the
mutual consent of the parties, the agreement may be extended for an
additional three (3) years.
5. City shall indemnify, defend and hold District harmless from
any liability for personal injury or property damage arising out of
the obligations of City under this agreement.
6. District shall indemnify, defend and hold City harmless from
any liability for personal injury or property damage arising out of
the District's use of the premises described herein when said use
is under the exclusive control of District, except that such
liability may arise out of the City's maintenance obligations set
forth herein.
