Interest of Contractor. It is understood and agreed that this agreement is not a contract of employment in the sense that the relation of master and servant exists between City and undersigned.At all times Contractor shall be deemed to be an independent contractor and Contractor is not authorized to bind the City to any contracts or other obligations in executing this agreement. Contractor certifies that no one who has or will have any financial interest under this agreement is an officer or employee of City. Changes. Road Repairs Fee Proposal Dear Travice: MPA Design is pleased to submit this fee proposal for landscape architectural services for the City of Cupertino, Stevens Canyon Road repairs. As we discussed yesterday, the disturbed area will be adjacent to the new wall, rip rap slope and paved edge of road and not the entire slope each side of road as previously thought. This greatly reduces the amount of slope to be exposed to possible erosion. Since irrigation will not be a part of this contract, we will carefully specify native plantings and moisture retentive soil mix and mulch to provide the best possible growth. Also, the commonly specified 60 day plant maintenance period may be increased to 90 days to insure plant survival through fall and into the rainy season. Our scope of work includes the following: 1. Create base drawing based on civil engineer's plans. 2. Provide design development plan identifying plant types, sizes, locations. 3. Provide estimate of probable construction costs. 4. Submit design development drawings by mail for City review and approval. e • Travice Whitten 2 May 16, 1986 5. Based on approved design development drawings and construction budget, prepare construction drawings and specifications including: A. Planting plan and details B. Specifications Compensation Our proposed fee for landscape architectural services for design development and contract documents will be $1,370. Construction consultation if requested, will be figured on a time and materials basis at time of construction. Direct costs such as printing, reproduction, freight, delivery charges, transportation, and long distance calls will be reimbursed at cost plus 10% above the lump sum fee.
