IMPROVEMENT AGREEMENT-3VNTA VISTA MAINTENANCE DISTRICT
We are enclosing to you for your files and information one (1) copy of the
Agreement by and between the City of Cupertino and Steven A. Lefton and
Karen M. Lefton, and Berland-One, A California Partnership, which has been
fully executed by City Officials, along with one (1) copy of Resolution
No. 7304, which was enacted by the City Council of the City of Cupertino
at their regular meeting of Tuesday, September 8, 1987.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AUTHORIZING EXECUTION OF AGREEMENT BETWEEN THE CITY AND
STEVEN A. LEFTON AND KAREN M. IEFTON, AND BERIAND-ONE,
A CALIFORNIA PARTNERSHIP; FOR OWNERS TO PARTICIPATE INA
MONTH VISTA MAINTENANCE DISTRICT
WHEREAS, in compliance with Condition 10 of Application 18-'IM-86,
there has been presented to the City Council an agreement between the City
of Cupertino and Owners Steven A. Lefton and Karen M. Lefton; and
Berland-One, A California Partnership; for Owners to participate in a
"Monts Vista Maintenance District"; and
WHEREAS, said agreement having been approved by the Director of Public
Works and the City Attorney;
NOW, THEREFORE, BE IT RESOLVE that the Mayor and the City Clerk are
hereby authorized to execute the aforementioned agreement in behalf of the
City of Cupertino.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Cupertino this 8th day of September , 1987 by the following

This AGREEMENT, made and entered into -this 21st -- day
of August , 19 87 , by and between the CITY OF QTPEFtPINO, a
municipal corporation of the State of California; hereinafter designated
as CITY, and STEVEN A_ LEFTON AND KAREN M. LEFTON, BERLAND-ONE, A
CALIFORNIA PARTNERSHIP hereinafter designated as OWNERS

WITNE-SSETH
WHEREAS, said Owners -- desires to subdivide certain land within the
City of Cupertino in accordance with the map heretofore filed with the
City Council of the City of Cupertino, marked and designated as
BAS HOMES, INC. Cupertino,
California, hereinafter designated as the project and -- - - - -
WHEREAS, CITY hereby approves the improvement plans and..specifications - _
prepared for the project by Civil Engineer Associates --- -
, a true copy of said improvement plans and
specifications are on file in the Office of _the_ _City -Engineer of _
Cupertino; and - -
WHEREAS, the same are innporated herein by reference, the same as
though set out in full;
NOW, T EREFORE, said improvement plans and specifications shall be
hereinafter called the "Plans," and the maintenance to be accomplished - -
herein is on said area covered by the "Plans". ; _ - - - -
The owners " further agree to join a "Monts Vista-Maintenance
District" for the repair, replacement and maintenande.of_the

The owners agree. to comply with condition 10 of 18-TM-86
and within thirty (30) days of a City request to participate in
the formation of said district.
TERMS AND CONDITIONS
It is further agreed that the..abcve. named terms and conditions for the
said Tract shall bird the heirs, surcPssors, administrators or assigns of
the OWNERS . The assignment of this AteT shall not be made without
approval by the City Council of said CITY. - -
