AUTHORIZING EXECUTION OF AGR NEW BETWEEN TIM CITY AND
DOUGLAS R. IJSSUK AND HAZEL B. RUSSUM RELATIVE TO PROPERTY
CT NO= STELIMiG ROAD AT THE FLUTE 280 BRIDGE
BE IT HER]MY RESOLVED that the City Council of the City of Cupertino
authorizes the Mayor and the City Clerk to execute the agreement between
the City of Cupertino and Douglas R. Russum and Hazel B. R ssun, providing
for the Russums to dedicate that portion of their property needed by the
City to ccnplete its sidewalk project. In exchange for said dedication,
the Russums shall not be required to reimburse the City for cost of street
improvement's.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Cupertino this 7th day of August , 1989, by the

AGREEMENT
This AGREEMENT made and entered into this qday of
1989, by and between the CITY OF CUPERTINO, a municipal corporation of the
State of California, hereinafter designated as CITY, and
DOUGLAS R. RUSSUM AND HAZEL B. RUSSUM
hereinafter designated as OWNERS.
The Owners have dedicated the property shown on the attached Exhibit
A. In exchange for this dedication, it is agreed that future development
of this property shall not require reimbursement to the City for costs of
street improvements as shown on the City plans by Kier & Wright, Civil
Engineers, File No. 98,016.2. Additional conditions nay be required at
the time of development.
This AGREEMENT shall bind . the heirs, administrators, executors,
successor, assignee and transferrees of the OWNER. The assignment of this
AGREEMENT shall not be made .without approval by the City Council of the
City of Cupertino.
