APN: 3 75-23-046, 375-23-047 -2- •• .. ..·· RESOLUTION NO. 08-022 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO APPROVING THE PURCHASE OF PROPERTY FROM THE SAN JOSE WATER COMP ANY AT STERLING BOULEY ARD AND BARNHART A VENUE AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL NECE~SARY DOCUMENTS TO COMPLETE THE ACQUISITION WHEREAS, in March of 1999, the area known as Rancho Rinconada in the northeastern part of the City was annexed from the County into the City of Cupertino and part of the annexation included good faith commitments by the City to invest in infrastructure; WHEREAS, the City has since invested almost two million dollars in street maintenance and other work; however, there is no public park space directly serving the residents in the Rancho Rinconada area; WHEREAS, in June of 2007, the Council included f).mding for the acquisition and development of a property owned by the San Jose Water Company at the intersection of Sterling Boulevard and Barnhart Avenue to serve as a neighborhood park for the residents of Rancho Rinconada; WHEREAS, in January of 2008, a tentative agreement on a price of $1,500,000 for the property was reached and the agreement is subject to the approval of the City Council and the Water Company Board of Directors; NOW, THEREFORE, LET IT BE RESOLVED that the City Council of the City of Cupertino hereby approves the purchase of property from the San Jose Water Company for the development of the Rancho Rinconada Park at Sterling Boulevard and Barnhart Avenue in the amount of $1,500,000 and authorizes the City Manager to negotiate and execute all necessary documents to complete the acquisition.
