RECITALS WHEREAS, on April 26, 1988, the County and the Incorporated Cities entered into an agreement entitled "Agreement to Provide,Local Law Enforcement • Agency Access to the California Identification System" ("AGREEMENT"); and WHEREAS, since the date of the AGREEMENT, the County and Incorporated Cities have entered into ten amendments to the AGREEMENT to modify various terms and extend the term of the amended AGREEMENT through June 30, 1999; and • 63347_1 1 • •JRG:CBM:ED:rm • 1/6/99 • WHEREAS, the County and the Incorporated Cities desire to extend the term of the amended AGREEMENT for another year; - NOW, THEREFORE, in consideration of mutual promises and benefits the County•and Incorporated Cities agree that the amended AGREEMENT be further amended as follows: SECTION 1. Section 3 of the AGREEMENT, entitled "TERM" is amended in full to read as follows: "The term of this AGREEMENT shall commence upon the date of execution of this AGREEMENT by all parties and shall terminate on June 30, 2000,unless terminated earlier as provided herein. It is anticipated that the parties will renew this AGREEMENT beyond June 30, 2000, by an express written amendment." SECTION 2. As required under Section 6.c.3. of the AGREEMENT, a list setting out the operating budget for fiscal-year 1999-2000 and reflecting the financial • contributions of each party to the AGREEMENT for fiscal year 1999-2000 operating costs of the Local ID System,is attached and incorporated into this Eleventh Amendment as Exhibit A. SECTION 3. This Eleventh Amendment may be executed in one or more counterparts each of which shall be an original, but all of which together shall constitute one and the same document. SECTION 4. This amendment extends the term of the original agreement through June 30', 2000, and identifies the necessary financial contributions from each Agency to cover the operating costs of the Local ID System for fiscal year 1999-2000. If required, please have the agreement approved by your Council/Board and ensure that the authorized officials execute the document on behalf of your Agency. Please have the agreement signed by your Attorney and the appropriate official. After execution, please return the single signature page to me in the San Jose City Clerk's Office, at the address listed above. J Leona Bishop, Analyst Legal Support Division Enc. r is tal I/- RESOLUTION RESOLUTION NO. 99-244 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING EXECUTION OF ELEVENTH AMENDMENT TO AGREEMENT BETWEEN COUNTY OF SANTA CLARA AND THE CITY OF CUPERTINO TO PROVIDE LOCAL LAW ENFORCEMENT AGENCY ACCESS TO THE CALIFORNIA IDENTIFICATON (CAL-ID) SYSTEM WHEREAS, there has been presented to the City Council a proposed Eleventh Amendment to Agreement Between County of Santa Clara and the City of Cupertino to provide local law enforcement agency access to the California Identification (Cal-ID) System; and WHEREAS, the terms, conditions and provisions of the agreement have been reviewed and approved by the City Attorney and the Director of Administrative Services. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino hereby approves the aforementioned agreement and authorizes the Mayor and the City Clerk to execute said agreement on behalf of the City of Cupertino.
