RECOMMENDATION: Staff recommends that the Planning Commission take the following action: 1. Approve EXC-2004-13 subject to the model resolution. BACKGROUND: The applicant, Signage Solutions, requests sign exceptions for the height of two wall signs and the use of exposed neon for Elephant Bar Restaurant, under construction at 19780 Stevens Creek Boulevard. The exposed neon triggers approval from the Planning Commission; otherwise this item would have been heard by the Design Review Committee. DISCUSSION: Sign Height Based on the size of the Elephant Bar Restaurant tenant space, the Sign Ordinance limits the height of these wall signs on this building to 2'-0" . The applicant is proposing a wall sign with two lines totaling 3'-11". The top line consists of "Elephant Bar" and the bottom line reads "Restaurant." Each individual line is less than 2' -0" in height, and if the two lines were combined into one, it would not require a sign exception. However, the sign would appear awkward because it would run the entire length of the signage band that is part of the building's architecture. Part of the intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of signs as they relate to building design." The proposed exception meets the intent of the ordinance. Exposed Neon The Sign Ordinance requires review of any sign that uses exposed neon. The code does not specify what the standards for review of exposed neon are. Without specific standards, staff reviewed the proposed use of neon with the purpose statements of the Sign Ordinance. 1- J EXC-2004-13 Page 2 The following are relevant points from the intent of the Sign Ordinance: . Provide regulations that allow for good visibility for the public and the needs of the business while providing for the safety of the public by minimizing distraction to the motorist and pedestrian; o None of the exposed neon will face the adjacent residential condominiums. o The amount of exposed neon proposed will not be a distraction to motorists or pedestrians. . Provide for sign regulations that will be compatible with the building, siting, and the land uses the signs are intended to identify; o The use of exposed neon is consistent with similar land uses. Exposed neon has been approved for restaurants such as Outback Steakhouse (1994) and BJ's Restaurant (2002), both of which are restaurants with separate bars, as is Elephant Bar. Sign Installation The proposed signs have already been installed on the building. Staff believes this was due to miscommunication between the representatives of the Elephant Bar Restaurant and the sign company.
