Pinole, CA 94564.510.964.0394 August 12, 2013 Kevin Dare Sand Hill Property Company kdare(a,shPco.com Re: Preconstruction Survey for Burrowing Owls and Nesting Birds, Including Raptors Main Street Cupertino Project, Cupertino, CA Dear Kevin: On August 11, 2013, an initial site visit was performed at the approximately 17.5 -acre Main Street Cupertino Project site at Stevens Creek Boulevard, Finch Avenue and Vallco Parkway in Cupertino. A habitat assessment and preconstruction survey for burrowing owls and nesting birds, including raptors, was conducted by Debra Chromczak as required by Mitigation Measure MM BIO -1.4 of the Mitigation Monitoring and Reporting Program (City of Cupertino, January 2009 revised March 2012). The survey area included the project site and surrounding habitat extending 500 feet from the project boundary. See Figure 1 for biological references. Habitat Assessment The site contains marginal, mowed grassland habitat with suitable ground squirrel burrows (3 - inch diameter or greater) with the highest burrow density in Parcel 1, west of Finch Avenue. An abundance of trees and shrubs provide nesting and evening roosting opportunities for migrating and resident songbirds and raptors. Small fossorial rodents, a source of prey for raptors, are present on site. The site is surrounded by a commercial and industrial urban landscape. Burrowing Owl Survey A diurnal walk-through transect survey was conducted to identify active burrowing owl burrows and the presence of burrowing owls. Due to burrow availability, the first of four focused dusk surveys was conducted from 19:10 to 21:20. No burrowing owls or active owl burrows were observed within the survey area during the transect survey or the focused dusk survey. Nesting Bird and Raptor Survey All trees, shrubs, and downed vegetative debris within the survey area were inspected for nesting birds and raptors. Six nest locations were observed: one nest within the project boundary and five nests within the 500 -ft buffer adjacent to the project site. Three large stick nests north of Vallco Parkway were observed and determined to be inactive, historic nest locations. Further Main Street Cupertino Project Mosaic Associates Preconstruction Survey - 8/11/13 Debra Chromczak observations are required to evaluate nest status on the remaining three nests: two large stick nests located east of Tantau Avenue and one grass/bark nest in a palm north of Stevens Creek Boulevard within the project site. Species Observed Within the Project Site Birds: Red-tailed hawk - adult foraging over Parcel 3 American kestrel - female calling/foraging from snag American crow Turkey vulture Mourning dove - pair flushed from snag Killdeer Black phoebe Bewick's wren House finch - female & juvenile by north creek Bushtit Rock pigeon Mammals: California ground squirrel Western gray squirrel 2 Striped skunk carcasses Domestic dog Reptiles: Fence lizard Additional Site Visits Three additional site visits are required to conduct three burrowing owl focused dusk surveys. Dusk surveys will be conducted on August 18, 20, and 25. Prior to starting the dusk surveys, the three identified nests will be observed to evaluate nest status. An active nest is defined as a nest containing eggs or young that have not fledged. If an active nest is observed, a protective buffer will be installed to protect the nest until the young fledge. Construction activities can proceed outside the buffer. A biologist will need to monitor the nest for negative impacts to nesting success and to determine when the young have fledged so work may proceed. Fortunately, we arc approaching the end of the breeding season for most avian species reducing the potential for an active nest.
