Staff Member Tsumura explained that the applicant has submitted an application for a Fence Exception to allow existing fences to remain that was constructed in the street and front setback areas. The applicant's landscape plans indicated that a 6' street sidefence would be constructed outside the setback area and the columns in the front yard were to be 36". At inspection, it was discovered that the street fence is within the setback area and that the columns are 42" high. The Applicant has submitted a justification statement listing supporting reason that they should be allowed to keep the fence in its 2 Design Review Committee August 3, 2017 current location. 1) The fence was constructed in the wrong place due to an error made by their contractor. Staff maintains that the contractor's error isnot a sufficient reason to grant a fence exception, further, allowing the difference to remain will set a bad precedence in the neighborhood. 2) The original grading and drainage plan and the revised landscape plan show the sanitary cleanout in different feet away (2' when it is really 5) from the property line. Staff member Tsumura explained that in the original drawing the placement of the proposed fence and the property cleanout were not in conflict, so staff made no mention it at the time of approval. 3) The original landscape plan shows the fence being constructed to the west and 5' of the property line of three property line trees. The fence was actually constructed to theeast of thetreesand within thesetback area. Staff mentioned that thetrees in question are not protected trees, and so could've been removed or relocated to avoid conflict with thewall. Staff cannot support the applicant's rational for the fence remaining as it is. He feels that other options were not investigated such as relocating theentirewall orjust asking for an exception for portionsof the fence where there is encroachment to the sanitary cleanout cover. Staff recommends denial of the Fence Exception. Chair Paulsen asked for clarification of where the property line for the site was located. He asked the applicant if she has approached the contractor about fixing their error. She stated that she had not. The contractor hired to install the fence did not have a license and so she can't ask him to come back. She admitted that it was a mistake. She really doesn't want to remove the trees along the fence because they are maturetrees. Staff member Tsumura pointed out that thetrees are not protected trees. Chair Paulsen opened the Pu bl i c Com ment period. Janice Burriesci, a resident: She addressed the Committee regarding the turn onto Alves Drive from Stelling Road. She made mention of a young woman who was hit by a car while crossing Alves and died in the accident. There area lot of peoplewalking along Alves Drive. It is dangerous. She said that a low, setback fencewould help with thevisibility on thecorner. Kaye DeVries, a resident: Her concern was also site visibility. She recognized that the new home was very nice and that there is a need for privacy and noise reduction. However, she said, there is too much foot traffic and people cannot be seen by cars because of the high fence. There is a safety factor that must be considered. There have been 2 pedestrian deaths on Alves. Chair Paulsen closed the Public Comment period. Commissioner Fung clarified that the applicant was requesting to keep a 6' wall along Stelling Road. The issuewith that wall was itsplacement and theissuewith thewall in thefront was the decorative features that exceed the height allowed for front yard fences. He clarified the traffic pattern on Stelling from/to Alves. And made mention of the flashing crossing lights which is an indication of mitigation efforts by the City to raise the awareness of pedestrians. He biggest concerns were how much the wall line encroaches into the required setback area. He asked Staff member Tsumura what the options were to moveor breakup thewall line. He said that thewall could've been broken up to be in thesetback area in front of the trees and clean put and have the rest of the wall be within the setback. He noted that this configuration would still requirea Fence Exception application. Chair Paulsen concurred with Staff recommendation. Hedoesnot like having wallsagainst thesidewalk. He felt that the blocking off of the trees was a detriment to the whole neighborhood and any walkers along there. He also felt that the applicant should have taken more care with whom she hired to build the fence. He felt that the setback requirements needed to be adhered to. The safety aspect was also of great concern. He felt that the fence should be removed. He further suggested that if the applicant should choose to plant a hedge, it should be kept trimmed to allow for better visibility for the cars turning left onto Alves. Commissioner Fung clarified that the 6' wall could be built on the property behind the 5 foot setback area. Staff member Tsumura also suggested that the wall could remain in its current location, but would 3 Design Review Committee August 3, 2017 need to be lowered to 3' in order to be in conformance. Commissioner Fung said that he concurred with Chair Paulsen. He felt that the contractor issue was bad, but that the applicant could've worked with Staff earlier in theprocessand avoided thissituation. CMC Chapter 19.12, Administration, requiresthat the Design Review Committeereview and approve requests for exceptionstothedevelopment standards established by the Fence Ordinance. Analysis: Site Description: The subject site is located in the Monta Vista Planning Area, south of Stevens Creek Boulevard and north of McClellan Road. The property was incorporated into the City of Cupertino and rezoned to Planned Light Industrial, P(ML), in 1984. The Planned Development zoning designation provides for greater flexibility of design and land use intensity due to existing legal non -conforming sites and/or structures. Surrounding land uses include industrial and residential uses to the north and east and residential uses to the south and west (Figure 1). The site is immediately adjacent to an automotive repair shop to the north and asingle-family residence to the south. Ascurrently designed, the subject site does not provide a transition or buffer between the two distinct uses (Figure 2). ' o I s e 0 - z_ Tran s Res Medium 10-20 as 5 Ind Figure 1. Surrounding Land Uses Security: The Santa Clara County Sherriff's Department confirmed that there has been a relatively small number of burglariesand theftswithin the past five (5) years along Imperial Avenue surrounding the subject property. Since 2013, a total of five (5) burglaries and 11 thefts have been reported. Existing businesses within the focus area of the police report primarily consist of automotive service and repair stations. The proposed businessfor thesubject property is Rebel Sun Productions, a video and audio equipment rental company, which can beatarget for burglary. Rebel Sun Productions experienced a burglary in 2015 while operating in Mountain View. The burglary resulted in over $70,000 worth of equipment loss and damages. Subsequently, a security gate was installed at the Mountain View property. No other burglaries have occurred at the property since the installation of the security gate. Design: The design review guidelines are regulated by the Fence Ordinance, which outlines that fences and walls separating industrial zones from residential zones shall be constructed to acoustically isolate part of or all noise, ensure visual privacy for adjoining residential dwelling units, and provide for sight visibility. The Fence Ordinancedoes not identify setback requirementsfor fences located in zones requiring design review. Additionally, there is no established setback pattern for existing fences or driveway gates within the Monta Vista Planning A rea. The applicant is proposing a six (6) foot redwood driveway gate to be set back ten (10) feet from the front property line (Figure 3). The front driveway gate will connect to the existing six (6) foot chain-link fence for the adjacent automotive repair shop and to theexisting six (6) foot concrete masonry unit (CMU) wall along the property line shared with the single-family residence. Staff recommends that the proposed driveway gate be setback a minimum of ten (10) feet to provide a buffer between the existing industrial and residential uses. The applicant is also proposing to install a landscape planter within the front setback area adjacent to the single-family residence. The proposed fence setback and landscape buffer are consistent with the General Plan Policy LU-26.4toincorporate building transitions, setbacks, and landscaping to provide a buffer for adjoining low -intensity residential uses. The scope of work also includes improvements to the parking lot layout in order to be consistent with the Cupertino Parking Ordinance. Figure 2. Existing Ste Figure 3. Proposed Rendering Other Department/Agency Review: The City's Building Division and the Santa Clara County Sheriff's Office reviewed the project and indicated that the driveway gate complies with relevant and ap p I i cabl e cod es. The Santa Clara County Fire Department has reviewed the proposal, and added a condition of approval that an approved Knox padlock shall be installed for the manual driveway gate. The Public Works Department has reviewed the proposal, and added a condition that the height of the existing CM U wall shall be reduced to three (3) feet within thefence setback to enhance visibility. Environmental Assessment: Theusepermit iscategorically exemptfrom the California Environmental Quality Act (CEQA) per section 15303 (New Construction or Conversion of Small Structures) of the CEQA Guidelines. Permit Streamlining Act This project is subject to the Permit Streamlining Act (Government Code Section 65920 — 65964). The City has complied with the deadlines found in the Permit Streamlining Act. Project Received: May 14, 2018; Deemed Incomplete: June 13, 2018 Project Received: Ju I y 11, 2018; Deemed Complete: A u g u st 9, 2018 The City has up to 60 days from the date of deeming the project complete (until October 9, 2018) to make a decision on the project. Conclusion Staff recommends approval of the Fence Exception as the driveway gate is needed for demonstrated security reasons. Furthermore, the proposed driveway gate and related site improvements will improve the design relationship between the existing industrial and residential uses. Together, the fence setback, reduction in the CM U wall, and the proposed landscaping will provide a buffer for adjoining low -intensity residential uses. Additionally, all of the findings for approval of the exception, consistent with Chapter 19.48, Fences, of the Cupertino Municipal Code, may be made as reflected in the Draft Resolution. N ext Steps The Design Review Committee's decision on this project isfinal unless an appeal isfiled within 14 calendar daysof thedecision, on September 20, 2018. If appealed, the City Council will betheapproval authority on theappeal. If approved, the approval will expire on September 6, 2019, at which time the applicant may apply for a one-year extension. The granting of the exception will not result in acondition which ismaterialIy detrimental to the public health, safety or welfare. The proposed driveway gate adheres to the Santa Clara County Fire Department's safety requirements and a condition of approval has been added from the Santa Clara County Fire Department to ensure access in emergencies. A separate condition of approval has been added from the Public Works Department requiring the existing concrete masonry unit wall to be reduced to three (3) feet in height in order to enhance vehicular visibility. Safety conditions for pedestrian and vehicular traffic will improve from enhanced visibility. 3. Safety conditions for pedestrian and vehicular traffic will improve from enhanced visibility. 5. The proposed development is otherwise consistent with the City's General Plan and with the pu rpose of thi s chapter as d escri bed in Section 19.48.010 The proposed driveway gate is otherwise consistent with the City's General Plan since the fence provides increased security for the property. The proposed fence setback and landscape buffer are consistent with the General Plan Policy LU -26.4 to incorporate building transitions, setbacks, and landscaping to provide a buffer for adjoining low -intensity residential uses. 6. The proposed development meets the requirements of the Santa Clara Fire Department and Sheriff's Department, and if security gates are proposed, that attempts are made to standardize access. A condition of approval has been added to ensure standardized access. 7. Thefence height for the proposed residential fence is needed to ensure adequate screening and/or privacy. The proposed exception is not for a residential fence. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of the maps, facts, exhibits, testimony and other evidence submitted in this matter, subject to the conditions which are enumerated in this Resolution beginning on PAGE3thereof: The application for a Fence Exception Permit, Application no. INDEMNIFICATION Except as otherwise prohibited by law, the applicant shall indemnify and hold harmlessthe City, its City Council, and its officers, employees and agents (collectively, the "indemnified parties') from and against any claim, action, or proceeding brought by a third party against one or more of the indemnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for theproject, including (without limitation) reimbursing the City itsactual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys' feesand costswithin 30daysfollowing receipt of invoicesfrom City. Such attorneys' fees and costs shall include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costsdirectly related to the litigation reasonably incurred by City. 6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS, OR OTH ER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions.
