TERMS The services and/or materials furnished under this Agreement shall commence on As Soon As Possible
and shall be completed before 4/28/80
COMPENSATION For the full performance of this Agreement, t_ITY shall pay CONTRACTOR:
Two Thousand Six Hundred Thirty—seven Dollars ($2,637.00)
GENERAL TERMS AND CONDITIONS
Hold Harmless. Contractor agrees to save and hold harmless the City, its officers, agents and employees from any and
all damage and liability of every nature, including all costs of defending any claim, caused by or arising out of the per-
formance of this agreement. City shall not be liable for acts of Contractor in performing services described herein.
Insurance. Should the City require evidence of insurability Contractor shall file with City a Certificate of Insurance
before commencing any services under this agreement. Said Certificate shall be subject to the approval of City's
Director of Administrative Services.
Non -Discrimination. No discrimination shall be made in the employment of persons under this agreement because of
the race, color, national origin, ancestry, religion or sex of such person.
Interest of Contractor. It is understood and agreed that this agreement is not a contract of employment in the sense
that the relation of master and servant exists between City and undersigned. At all times Contractor shall be deemed to
be an independent contractor and Contractor is not authorized to bind the City to any contracts or other obligations in
executing this agreement. Contractor certifies that no one who has or will have any financial interest under this
agreement is an officer or employee of City.
Changes. This agreement shall not be assigned or transferred without the written consent of the City. No changes or
variations of any kind are authorized without the written consent of the City.

I, the undersigned, agree to perform the work in accordance with the
project specifications and to the standards of workmanship that meet
or exceed those of the City of Cupertino, for those amounts outlined
in the incorporated schedule.
All "Clean-up" is to be included and all work shall be accomplished
in accordance with the regulations of O.S.H.A.

1. SCOPE OF I�ORK
The work involved within this contract is to redistribute existing sand
within a tank foundation area, and then to provide and install "Tank
Mix". The area is to be uniformly sloping and to be compacted to 90%
relative density.
2. LOCATION
An existing site on :fann Drive within the City of Cupertino north of
Stevens Creek Boulevard. A location map is attached.
3. GENERAL SPECIFICATIONS
The Contractor shall excavate or haul the existing sand foundation material
from near the existing tank ring wall to the interior of the 60 foot
diameter area.
The Contractor shall then haul in place "Tank :-Six" as required to provide
a minimum of 2" of the "Tank fix" (17 cubic yard maximum)
The "Tani: Mix" area shall then be compacted to 907, relative compaction.
The "Tank Hix" shall be as provided by .:eed and Craham Company of San Jose.
4. BONDS
No bonds will be required. however, workman's compensation and liability
insurance ($300,000/$500,000) are a requirement of this informal contract.
