81-032 Metropolitan Transportation Commission - Transportation Development Act Funds for FY 1981-82 Reso 5588Oftl of Capem"o Gty of Cupertino 10300 Torre Avenue Cupertino California 95014 (408) 252-4505 To: METROPOLITAN TRANSPORTATION COMMISSION From: Charles Kilian, Cupertino City Attorney Date: March 24, 1981 Subject: ELGIBILITY FOR TRANSPORTATION DEVELOPMENT ACT FUNDS This communication will serve as the requisite opinion of counsel in connection with the application of the City of Cupertino for an allocation of Transportation Development Act (TDA) funds. 1. The City of Cupertino is authorized to provide and assist public transportation by acquisition, construction and operation of existing or additional transit facilities. This assistance may be provided directly or by contractual arrange- ments with other parties. 2. The City of Cupertino is an eligible claimant for Transportation Development Act (TDA) funds pursuant to PUC Section 99275. 3. I have reviewed the pertinent State and local laws, and I am of the opinion that there is no legal impediment to the City of Cupertino making applications for TDA funds. Furthermore, as a result of my examinations, I find that there is no pending or threatened litigation which might in any way adversely affect the proposed projects, or the ability of the City of Cupertino to carry out such projects. i arles T.
