Insurance. Should the City require evidence of insurability Contractor shall file with City a Certificate of Insurance
before commencing any services under this agreement. Said Certificate shall be subject to the approval of City's
Director of Administrative Services.
Non -Discrimination. No discrimination shall be made in the employment of persons under this agreement because of
the race, color, national origin, ancestry, religion or sex of such person.
Interest of Contractor. It is understood and agreed that this agreement is not a contract of employment in the sense
that the relation of master and servant exists between City and undersigned. At all times Contractor shall be deemed to
be an independent contractor and Contractor is not authorized to bind the City to any contracts or other obligations in
executing this agreement. Contractor certifies that no one who has or will have any financial interest under this
agreement is an officer or employee of City.
Changes. This agreement shall not be assigned or transferred without the written consent of the City. No changes or
variations of any kind are authorized without the written consent of the City.

peak hour.

PROPOSED WORK PROGRAM - CUPERTINO ENERGY STUDY
I. Refine work program with City staff and collect data.
Time: 8 hours Cost: $240
II. Establish baseline energy use by sector, 1981 and 1990:
residential;
commercial/industrial;
transportation.
Primary sources of data on energy usage for the 1981 baseline will be PG&E,
the California Energy Commission (CEC) and Sedway/Cooke calculations based
on more generalized information. The primary source of data on land -use and
transportation characteristics will be the City staff.
If energy use by S.I.C. Code can be obtained from PG&E within the timeframe
of this study (it has already been requested), the baseline energy use will be
expressed in a more disaggregated form than the above three categories.
Similarly, if quantitative data on the geographic distribution and size structure
of the existing building stock is available for the city, energy use in sub -areas
of the city can be determined.
The City's source of transportation data is its traffic model which only
provides information on home -to -work trips. Shopping, recreational and
miscellaneous trips which, when combined constitute a larger portion of the
total vehicle miles travelled (VMT) than home -to -work trips, will have to be
characterized on the basis of studies not specific to Cupertino unless the City
staff can develop such estimates. (This characterization is important because
the impacts of changes in land -use pattern on VMT are sensitive to trip type.)
The 1990 baseline energy use (excluding changes in energy use due to new
development and transportation system modifications) will be estimated based
on: City staff's land -use and population projections, City staff estimate of
removal rate by building type or statewide average, CEC/Sedway/Cooke esti-
mates of energy usage for existing structures based on anticipated market
penetration of energy conservation measures, EPA estimates of mileage, City
projections and (if necessary) Sedway/Cooke estimate of VMT by type of trip
and trip length.

III. Characterize land-use/transportation alternatives for energy analysis.
City staff will provide up to five land-use/transportation alternatives. It is
anticipated that consultant will work with staff to assure that the information
needed for the energy analysis is included in the characterization of the alter-
natives.

IV. Analyze energy use for each alternative.
The energy used by each alternative for building operation and transportation
will be estimated based on the above characterizations and CEC/Sed-
way/Cooke estimate of energy use by building type and EPA mileage

The energy required to construct the alternative - referred to as "bound"
energy - will also be evaluated. As operational energy use decreases due to
increased efficiency, the energy required to construct and maintain a facility
becomes an increasingly important measure of energy efficiency. For
example, in the transportation section this analysis can compare energy savings
from vehicle operation over the I.ife of an improvement with energy costs for
construction and maintenance of the improvements.

V. Compare alternatives.
The energy -use implications of the alternatives will be expressed in terms that
are meaningful to the lay person, specifically as costs to residents in 1981
dollars (excluding inflation) and 1990 dollars (including inflation).
The relative effects on regional and local energy supplies, in particular the
need for new electrical generating facilities, will be described.

the current G.P. and 2) the increase due to implementation of the "upper tier"
development option. A "build" and "no build" "85" Corridor will be assessed for
both land use plans. The build option involves the construction of a two or four
lane roadway from Stevens Creek Boulevard to Saratoga -Sunnyvale Road. It is
anticipated that consultant will work with staff to assure that the information
needed for the energy analysis is included in the characterization of the alter-
natives.

IV. Analyze energy use for each alternative.
The energy used by each alternative for building operation and transportation
