Project Title: Second Addendum to the General Plan Amendment Housing Element Update and Associated
Rezoning Environmental Impact Report (Addendum)
Project Location (include county): The Vallco Shopping District (project site) comprises approximately 70 acres
north of Stevens Creek Boulevard and Wolfe Road, Cupertino, Santa Clara County.
Project Description: The approved project consists of amendments to the General Plan, adoption of an update to the
Housing Element, and associated rezoning. The proposed modifications to the project are to the land uses, amount of
development, and height of structures allowed in Final EIR Study Area 6 (Vallco Shopping District). The project
creates two new General Plan land use designations — Regional Shopping and Regional Shopping/Residential for the
Vallco Shopping District; establishes a minimum density of 29.7 du/ac and a maximum density of 35 du/ac with the
option of including ground floor commercial uses on 13.1 acres of the Vallco Shopping District; designates a
maximum height of up to 60 feet for the Vallco Shopping District; removes 2.0 million square feet of office
development allocation from the Vallco Shopping District; and establishes a setback -to -height limitation for
development from the shared property line between the North Blaney neighborhood and the Vallco Shopping District.
This is to advise that the City of Cupertino as the Lead Agency for the above-described project has made the following
determinations regarding the above-described project:
1. No further environmental review is required for the modifications to the project.
2. The proposed modifications to the original project described and certified in the Final EIR in December 2014,
as modified by an addendum adopted in October 2015, will result in no new significant adverse effects or
substantially increase the severity of significant effects previously identified. Thus, the current proposed project
modifications meet all the conditions for an addendum.
3. The mitigation measures that were adopted and incorporated into the project analyzed in the Final EIR will
remain in effect. No new or modified mitigation measures were identified in this Addendum to the Final EIR.
4. A Statement of Findings and a Statement of Overriding Considerations were made at the time of approval of
the project analyzed in the Final EIR. No changes to these Statements are required as a result of the proposed
project modifications evaluated in this Addendum to the Final EIR.

The City of Cupertino adopted the 2014-2022 Housing Element Update on May 19, 2015. The purpose of the 2014-2022
Housing Element Update is to make adequate provisions for the existing and projected housing needs of all economic segments
of the community and to provide appropriate land use designations to accommodate the City's Regional Housing Need
Allocation for the planning period. The means of achieving the development of these units are provided for in the policies and
programs described in the Housing Element. In accordance with CEQA, the City prepared an EIR (SCH #2014032007) for the
General Plan Amendment, Housing Element Update, and Associated Rezoning Project, which analyzed all of the significant
environmental effects of the 2014-2022 Housing Element Update. The EIR was certified by the City of Cupertino on December
5, 2014. Minor modifications to the 2014-2022 Housing Element Update made in response to public comments and comments
by the California Department of Housing and Urban Development do not require major revisions to the EIR due to new or
substantially more severe significant environmental effects than were analyzed in the EIR. There have been no substantial
changes with respect to the circumstances under which the 2014-2022 Housing Element Update would be undertaken and no

General Plan Amendment, Housing Element Update, and Associated Rezoning Project ("Final EIR"), which was certified by the City
of Cupertino on December 5, 2014. The approved project consists of minor modifications and revisions to Community Vision 2040
including text edits to re-insert 2005 General Plan text, policies or strategies; reorganization of strategies in the Infrastructure
Element; correction of typographical errors, grammatical errors, and certain headings; clarification of existing policies and
strategies to clarify the intent; revisions to ensure internal consistency; clarifications and corrections to General Plan figures;
adding new figures related to Special Areas and Noise; amending the land use designation for the Mirapath site on 10950 North
Blaney Avenue from Industrial/Residential to Industrial/Commercial/Residential and adding the new designation as a new land
use category in the General Plan; rezoning the Mirapath site from Light Industrial with special development conditions (ML -fa) to
Planned Development with Light Industrial and General Commercial uses or P(ML/CG); and, changing the name of the General
Plan, "Community Vision 2040," to "General Plan (Community Vision 2015-2040). The City prepared an Addendum to the EIR for
the General Plan Amendment, Housing Element Update, and Associated Rezoning project because the modifications to the
project analyzed in the Final EIR consist of minor technical changes, clarifications, amplifications or revisions to the text and
figures of the General Plan and Zoning Ordinance, and do not require major revisions to the previously certified EIR due to new or
substantially more severe significant impacts.
This is to advise that the City of Cupertino has approved the above described project on October 20, 2015 and has made the
following determinations regarding the above described project:
1. No further environmental review is required for the minor modifications and revisions to the General Plan and rezoning of
the Mirapath site.
2. The proposed minor modifications and revisions to the project described in the certified Final EIR will result in no new
significant environmental effects or a substantial increase in the severity of a significant environmental effect previously
identified.
3. There have been no substantial changes with respect to the circumstances under which the minor modifications and
revisions would be undertaken that would require major revisions of the Final EIR due to new or substantially increased
significant environmental effects, and there has been no discovery of new information of substantial importance that would
trigger or require major revisions to the Final EIR due to new or substantially increased significant environmental effects.
4. The mitigation measures that were made adopted and incorporated into the project analyzed in the Final EIR will remain in
effect. No new or modified mitigation measures are required.
5. CEQA Findings and a Statement of Overriding Considerations were adopted at the time of the approval of the project
analyzed in the Final EIR. No changes to the Findings and Statement of Overriding Considerations is required as a
result of the minor project modifications and revisions evaluated in the Addendum to the December 2014 Final EIR.
6. The approved minor project modifications and revisions meet all the conditions for an Addendum.
This is to certify that the final EIR with comments and responses and record of project approval is available to the General
Public at the City of Cupertino, 10300 Torre Avenue, Cupertino, CA 95014.
