FIRST AMENDMENT TO AGREEMENT 20-009
BETWEEN THE CITY OF CUPERTINO AND
COLUMBIA TELECOMMUNICATIONS FOR
WIRELESS AND FIBER OPTIC MASTER PLAN
DESIGN SERVICES
This First Amendment to Agreement 20-009 between the City of Cupertino and Columbia
Telecommunications, for reference dated 8/4/2020, is by and between the CITY OF CUPERTINO, a
municipal corporation (hereinafter "City") and Columbia Telecommunications, a Corporation
(“Contractor”) whose address is 10613 Concord Street, Kensington, MD, 20895, and is made with
reference to the following:
RECITALS:
A. On 1/22/20, an agreement was entered into by and between City and Contractor
(hereinafter "Agreement") for wireless and fiber optic master plan design services.
B. City and Contractor desire to modify the Agreement on the terms and conditions set
forth herein.
NOW, THEREFORE, it is mutually agreed by and between and undersigned parties as
follows:
1. TERM
Paragraph 3.1 of the Agreement is modified to read as follows:
3.1 Term. This Contract begins on the Effective Date and ends on June 30, 2021
("Contract Time") unless terminated earlier as provided herein. Contractor's Work shall begin
on the date shown on a written Notice to Proceed (''NTP") and must be fully completed within
the Contract Time or on the date specifically provided in the Notice to Proceed. The City
Engineer will not issue a NTP until the Contract is fully executed by both parties and City has
received satisfactory proof of insurance and any performance and payment bonds that may be
required.
2. Except as expressly modified herein, all other terms and covenants set forth in the
Agreement shall remain the same and shall be in full force and effect.
