PC Reso 158222 -TPI -76 RESOLUTION NO. 1582 OF THE PLANNING COMPffSSION OF THE CITY OF CUPERTINO RECOM"E:iDING APPROVAL OF A TENTATIVE `L4P SUBDIVISION MAP TO RECOMBINE APPRO=AATELY SEVEN PARCELS, CON- SISTING OF APPROXIMATELY 54 ACRES, INTO FOUR PARCELS APPLICANT: SOBRATO-BERG PROPERTIES ADDRESS: 2775 Middlefield Rd., Palo Alto, California 94306 SUBMITTED: September 3, 1976 LOCATION: Within the southeast quadrant of Route 280 Freeway and North De Anza Blvd. ACREAGE: 54 acres CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. That approval is based upon Exhibit A, 1st Revision, of 22-7.1-I-76, as may be modified by additional conditions contained herein. 16. That all non -fruit trees with a trunk diameter of 12 inches or greater shall be retained. Although it is desirable to retain all trees, a request for removal of any of said trees may be submitted and evaluated in conjunction with a more definitive use permit plan for said parcel. 17. The applicant shall submit an appropriate legal document providing for reciprocal ingress and egress easements between Parcels B and C and C and D in order chat the patrons of uses located within these parcels shall have the unrestricted right of access to ingress and egress driveways serving said properties from De Anza Blvd. and Mariani Ave. 18. The applicant shall provide easements adjacent to and parallel to . De Anza Blvd. with an adequate depth to provide for meandering side -walks as described on the approved Architectural and Site Approval Committee and use permit exhibits. Additionally, similar easements shall be provided along Mariani Ave. for sidewalk and bicycle paths. An easement shall be provided for a bus turn -out based upon design standards prepared by the Santa Clara County Transit District as approved by the City. 19. The applicant shall sign a written agreement agreeing to join an open space maintenance district when such district is formed to provide common landscaping maintenance for the 50 ft. landscape setback area adjacent to De Anza Boulevard. Until such time as said district is formed, the applicant shall be responsible for maintaining the land- scaped area in a manner acceptable to the City. 20. In the event the title to the 10 -ft. strip of property along the easterly boundary of the map, adjacent to the single-family residences fronting on Larry Way, is not passed to the applicant prior to recorda- tion of the final map, the staff shall eliminate said 10 -ft. strip from the final map. The applicant shall be required prior to commencement of construction of the industrial facility to construct the sound wall, -2- 22 -III -76 Resolution No. 1582 (continued) as described in the conditions of approval of the applicant's use permit, along the property line which separates the development from the above 10 -ft, strip. Should the developer or City acquire said 10 -ft. strip subsequent to the filing of the final map, the said final map shall be amended at the staff level and re-recorded, malting said 10 ft. strip a part of the subject development. Should.this occur, the applicant shall be required to relocate said sound wall at their own cost to the easterly boundary of said 10 -ft. strip adjacent to single-family residences on Larry Way. If acquisition of the 10 -ft. strip is noc accomplished by the applicant prior to recordation of the final map, the applicant shall, upon filing the final map, deposit with the City of Cupertino the sum of $12,500 which will be utilized to pur- chase said 10 -ft. strip from the existing owners.
