These approvals were made subject to the conditions imposed by Planning Commission Resolutions Nos. 1735 and 1714 respectively with both having first been amended. Planning Commission Resolution No. 1715 was amended by the deletion of Condition No. 22. Planning Commission Resolution No. 1714 was amended e:! by the deletion of Condition No. 16. APPLICANT: Sobrato-Berg Properties ADDRESS: 2775 Middlefield Rd., Palo Alto, California 94306 SUBMITTED: June 20, 1977 LOCATION: Northeast corner of the intersection of De Anza Blvd. and Mariani Ave. ZONE: CG (General Commercial) FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of July 13, 1977. • CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based on Exhibit A of Application 15-U-77, as may be modified by additional conditions contained herein. 16. The land use intensity shall be limited to an intensity that will not generate more than 16 one-way trips per acre during the peak traffic hour. For the purposes of the 16 one-way trip Traffic Intensity Performance Standard, the following accounting of trips is hereby incorporated into the project approval. Prior to issuance of a building permit, the applicant shall record a covenant to describe the trip acre constraint and the total number of trips allocated to the particular development at the time of the development approval. The covenant shall be worded in a manner to suggest that the future purchaser of properties consult the North De Anza Boulevard conceptual zoning file and individual use permit files to obtain an up-to-date status report of the total number of trips allocated to each particular property. The applicant shall submit a documentation for the seller of trips identified above indicating the trips have been transferred to the applicant. 18. The property owner/developer shall prcvide tenants with a written notice regarding potential traffic problems within the North De Anza Boulevard study area. Said notice shall stipulate that the City reserves the right to review traffic conditions within the area at any time in the future and should the City determine that con- straints to ensure proper traffic movement is necessary, the City may impose the appropriate constraints. A copy of said written • notice shall be signed by the lessee and forwarded to the City prior to occupancy of the building. 19. The applicants shall provide secured bicycle locking facilities at the bank and restaurant sites. The type of and number of said facilities shall be subject to approval of the Architectural and Site Approval Committee upon advice of the City Traffic Engineer. 20. Truck movements and refuse collection activity shall be in accordance with Section 10.45 of the Cupertino Municipal Code. 21. In the event parking becomes a problem relative to the restaurant/ banking facilities located at the northeast corner of North De Anza Boulevard and Mariani Avenue, provision shall be made for reciprocal parking easements with the adjacent industrial facility. • 22. Consistent with Condition No. 35 of Planning Commission Resolution No. 1568, the proposed driveway opening from De Anza Boulevard to the restaurant/bank site shall be deleted from Exhibit A. The applicants shall provide driveway access from the restaurant/bank site to the south side of the existing driveway serving the Four - Phase Systems industrial site. 23. The Architectural and Site Approval Committee shall review the subject development for compliance to City standards in parking lot layout. The Committee shall also study on -site pedestrian circulation patterns with intent to minimize non-public walkways within the 50-ft. landscaping parkway adjoining De Anza Boulevard. 24. The site planning for the financial institution portion of the subject site is conceptual in nature. The approval includes the general building location, the allocation of the one-way trips, the perimeter landscaping setbacks and access to public rights of way. Precise building area location, height and design con- cept shall be reviewed in detail by the Architectural and Site Approval Committee. -3- 15-U-77 Resolution No. 1715 (continued) ®' PASSED.
